Introduction
meno.us.com and app.meno.us.com are operated to provide CRM, playbook automation, and SMS messaging tools. These terms govern your use of this website and the meno application. By using them, you accept these terms in full. If you disagree, you must not use the service.
You must be at least 18 years of age to use meno. By using the service, you warrant that you are at least 18 years of age.
License to use website
Unless otherwise stated, meno and its licensors own intellectual property rights in the website, application, and materials published there. Subject to the license below, all rights are reserved. You may view, download for caching only, and print pages for your own personal use, subject to restrictions in these terms.
You must not:
- Republish material from this website in print or digital media without permission.
- Sell, rent, or sub-license material from the website.
- Show material from the website in public without permission.
- Reproduce, duplicate, copy, or exploit material for a commercial purpose beyond your licensed use of the product.
- Edit or modify website materials except through normal use of the application.
- Redistribute material from this website except where expressly permitted.
- Republish or reproduce any part of this website through iframes or screen scrapers without permission.
Acceptable use
You must not use this website or application in any way that causes or may cause damage, impairment of availability, or unlawful, fraudulent, or harmful activity.
You must not use the service to copy, store, host, transmit, send, publish, or distribute malicious software or conduct systematic data collection (scraping, data mining, harvesting) without express written consent.
You must not transmit unsolicited commercial communications without the prior consent of recipients, or use the service for marketing without express consent of recipients.
SMS messaging
meno offers the option for customers to send SMS messages to contacts, leads, members, or guests for follow-ups, reminders, and relationship outreach. Message frequency varies. Message and data rates may apply. Recipients may text HELP for help or STOP to cancel. Carriers are not liable for delays or undelivered messages.
You must have consent from all SMS recipients before sending. You are responsible for sending at reasonable hours for recipients. meno will be held harmless if you send communications without prior consent or send communications recipients find bothersome. Standard text message rates may apply for recipients.
User conduct
meno grants you a limited license to access the site and products. By using them, you agree to:
- Be 18 or older and authorized to use the service for your organization or practice.
- Understand that paid tiers may apply after beta; we will provide notice before charging.
- Be solely responsible for the content of your messages.
- Guarantee that your contacts have opted in to receive SMS from you and that you manage your subscriber list responsibly.
- Not send unsolicited communications (spam), junk mail, or chain letters.
- Not send defamatory, obscene, threatening, abusive, or illegal content, or content that infringes intellectual property or privacy rights.
- Not impersonate others when sending messages.
- Follow CTIA, Mobile Marketing Association, and carrier best practices for outbound messaging.
- Understand that message delivery is not guaranteed and SMS is not an emergency alert system.
meno may suspend or terminate access if we determine you violate these terms or our Privacy Policy.
meno will not use your contacts’ information for purposes other than providing the product and services.
Restricted access
Access to certain areas may be restricted. meno may restrict access to parts of the website or application at its discretion. If you receive credentials, you must keep them confidential. meno may disable credentials without notice.
User content
“Your user content” means material you submit to meno (text, images, contact data, messages, etc.). You grant meno a worldwide, non-exclusive license to use, store, reproduce, and process your user content as needed to provide and improve the service. Your content must not be illegal, infringe third-party rights, or give rise to legal action.
meno may edit or remove material that violates these terms. We do not undertake to monitor all user content but may review content when required for security, support, or legal compliance.
Refund policy
During beta, the core product is offered at no charge. If you purchase pass-through services (such as phone numbers or messaging credits) through integrated providers, refunds are governed by those providers’ policies.
When paid subscription tiers launch, refund terms will be published on the pricing page. Contact support@meno.app for billing questions.
No warranties
This website and application are provided “as is” without representations or warranties, express or implied. meno does not warrant constant availability or that information is complete, true, accurate, or non-misleading. Nothing on this site constitutes professional legal, financial, or medical advice.
Limitations of liability
meno will not be liable for direct loss (where the service is free-of-charge), indirect, special, or consequential loss, or business losses including revenue, profits, contracts, reputation, or data corruption, even if advised of potential loss.
Exceptions
Nothing in these terms excludes liability that cannot be excluded under applicable law, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Reasonableness
By using this website and application, you agree that the exclusions and limitations of liability are reasonable. If you do not think they are reasonable, you must not use the service.
Other parties
You agree not to bring claims personally against meno’s officers or employees. Limitations of liability protect officers, employees, agents, and subcontractors as well as meno.
Unenforceable provisions
If any provision is unenforceable under applicable law, the remaining provisions remain in effect.
Indemnity
You indemnify meno against losses, damages, costs, and liabilities (including legal expenses) arising from your breach of these terms or your use of the service, including SMS sent without proper consent.
Breaches
If you breach these terms, meno may suspend access, block IP addresses, or take other appropriate action.
Variation
meno may revise these terms from time to time. Revised terms apply from publication on this page. Check this page regularly.
Assignment
meno may transfer rights and obligations under these terms without notice. You may not transfer your rights without our consent.
Severability
If a provision is unlawful or unenforceable, the remainder continues in effect.
Entire agreement
These terms, together with the Privacy Policy, constitute the entire agreement regarding use of the website and application.
Law and jurisdiction
These terms are governed by the laws of the United States and the State of South Carolina, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of South Carolina, USA, except where prohibited by law.
